Statement ZestiSmoke code 10

Kerry Ingredients and flavours EMEA, statement on Zesti Smoke Code 10

Kerry Ingredients and Flavours are fully aware of the work currently underway at the European Commission to regulate and publish a Union List of authorised Primary Smoke Products together with their conditions of use.

The proposed regulation on Smoke Flavourings was on the agenda of the Standing Committee meeting held on 24th January 2011. At that meeting it was decided to defer work on further drafts of this regulation until the end of 2011. This decision was made in order to allow the European Food Safety Authority (EFSA) to complete their evaluations of additional studies that have been submitted in support of two primary products, one of which was Zesti Smoke Code 10.

The EFSA opinion on Zesti Smoke Code 10 was published on 27th of July 2011 in which it was stated that, based on the additional data presented, there was a significantly increased NOAEL (No Observed Adverse Effect Level). This opinion has now confirmed that the safety of Zesti Smoke Code 10 is in line with all other similar Primary Smoke products.

The EU Commission will now take these EFSA Opinions into account during the drafting of the Regulation on Primary Smoke Products.

Kerry Ingredients and Flavours would like to confirm to its customers the current status of Zesti Smoke Code 10:

  • The publication of the Working Documents on the proposed regulations by The Commission does not affect the legal use of Primary Smoke Products in food.
  • There is no requirement by the European Commission to withdraw Primary Smoke Products from sale or restrict their use in products.
  • Currently, all ten Primary Smoke Products which have been notified with valid dossiers in accordance with Regulation (EC) 2065/2003 on smoke flavourings used or intended for use in or on foods may be legally used in foods until the Union List of Primary Smoke Products has been established.
  • The publication of the latest EFSA opinion on Zesti Smoke Code 10 of 27th July 2011 does not affect the legal use of this product in food.

Through its membership of various trade associations and other organisations Kerry Ingredients and Flavours will continue to fully co-operate and work with the European Commission in the development of future regulations regarding the usage levels of smoke flavourings and the publication of a Union List of Primary Smoke Flavours.
Kerry Ingredients and Flavours will continue to monitor the situation closely and take appropriate action in-line with our customers needs and communicate openly with them on this matter.

ZESTI SMOKE CODE 10 - FURTHER INFORMATION

Notes to Support Statement on Zesti Smoke Code 10:

All primary liquid smokes are classified as smoke flavourings and are therefore subject to approval as part of the EU Flavourings Regulations.
EFSA (European Food Safety Authority) was requested by the EU Commission to evaluate all primary liquid smokes and to report on their safety at normal usage levels.
This work was completed and EFSA published its opinions in 2009-10
The EFSA opinions confirmed safety concerns for all the classical burnt wood smoke liquids at the normal levels of use. Zesti C10 was one of the smokes
The liquid smokes were given a “no adverse effect” score by EFSA which the commission will use to determine and then propose maximum usage levels in draft legislation.
Further testing was subsequently undertaken on Zesti C10 to show that its “no adverse effect level” is in the same range as its competitors.
This work was successfully completed and the revised statement published by EFSA in July 2011 confirmed this.
Zesti C10 and the other similar smoke flavourings are scheduled to be reviewed by the EU Commission in September 2011. The EU Commission will propose the maximum dosage for each of the smoke flavourings in the defined categories of food. Once agreed these levels will be formalised into the EU regulation.
Following the publication of the earlier draft regulation, Zesti C10 smoke is approved for use, the recent testing is to prove that a higher dosage level can be accepted.
